Follow us on Google NewsThe Swiss decision introduces another major step towards regulated crypto investing. Switzerland’s Financial Market Supervisory Authority (FINMA) has licensed the nation’s first Bitcoin (BTC) exchange-traded fund (ETF) that can invest directly in BTC and be made available to retail investors.
FINMA Opens Direct Bitcoin ETF Access to Retail InvestorsFINMA said growing demand for cryptocurrency investments, particularly Bitcoin, contributed to its decision.
The approved product is designated as an “other fund for alternative investments” in Swiss law with specific risks. The new structure is a regulated retail fund, which invests directly in Bitcoin, and it is one of the structures not already available in Switzerland which have been approved.
No information regarding the fund manager was provided by FINMA, nor was a launch date. But other issuers are also currently applying or announcing Bitcoin ETFs, the regulator noted.
The move broadens the base of investors by allowing individuals other than a professional investor to buy and sell index funds. The crypto fund, which was mainly targeted at qualified investors, received authorization from FINMA in 2021, a precursor to more regulated digital asset exposure.

Bitcoin Wins an Exemption From Diversification RulesA particular aspect of the approval is FINMA’s ruling that exempts the approval-holder from the standard risk-diversification requirements.
It’s typical to expect traditional investment vehicles to be diversified. But a Bitcoin ETF focuses investment solely on one cryptocurrency.
In the reason provided for its exception, FINMA cited Bitcoin’s relatively long trading history as well as its high volume of trading when compared to other digital assets. That enables the fund to still be directly exposed to Bitcoin, but within the regulated frame of Swiss funds.
Custody and Crypto Risk Controls Take Center StageThe approval has a number of restrictions on investors’ protection. Bitcoin custody risks, operational risks and other risks are things that financial institutions that handle the ETF must deal with. In the past FINMA has provided guidance on how supervised firms should improve safeguards for crypto assets, including measures for the prevention of asset loss.
Fund documents should also explicitly disclose the risks involved in the security, in addition to delving into the ways in which it differs from a traditional diversified fund.
Bitcoin’s own market risk remains if it is approved, emphasized FINMA. The btc exchange is highly volatile and investors may lose a big fraction of their capital, said the regulator.

Swiss Rules Demand Clear Bitcoin Risk WarningsThe distribution of the ETF will be governed by Switzerland’s Financial Services Act, better known as FinSA. This involves providing explicit warnings for the volatility and losses of Bitcoin and a suitability assessment where appropriate.
The design serves both goals – regulated access of retail investors to direct exposure to Bitcoin and the introduction of regulation for fund managers and distributors.
There are now already more Bitcoin ETF applications on the waiting list, and FINMA’s decision could pave the way for others to come on top of the Swiss regulatory framework for these new direct crypto investments.
